Refund Policy

Refund, Return, Exchange and Cancellation Policy

Effective Date: August 25, 2026

All Sales Are Final

Thank you for purchasing from The Distelheim Gallery, LLC (“The Distelheim Gallery,” “Gallery,” “we,” “us,” or “our”).

Because our offerings include original artwork, limited editions, hand-touched works, artist-designed products, custom-produced merchandise, collectible wearables and carefully packaged specialty items, all purchases are final unless otherwise expressly stated in writing by the Gallery or required by applicable law.

We do not offer refunds, returns, exchanges, order cancellations, price adjustments or credits because a customer:

  • Changes their mind;

  • No longer wants or needs the item;

  • Selects an incorrect product, size, color, design, format or shipping address;

  • Decides the artwork or product is not suitable for a particular room, décor, recipient or purpose;

  • Experiences differences between a product’s physical appearance and its appearance on a computer, tablet or telephone screen;

  • Finds a similar product or a lower price elsewhere;

  • Purchases an item as a gift that the recipient does not want;

  • Fails to read the product description, dimensions, materials, edition information, production time or care instructions; or

  • Is dissatisfied for a reason that does not involve a verified defect, Gallery fulfillment error or other legally protected claim.

Please review all product information carefully and contact the Gallery with any questions before completing your purchase.

Scope of This Policy

This policy applies to purchases made through:

  • The Distelheim Gallery website or online shop;

  • Telephone, email or written invoice;

  • A private appointment, consultation or salon;

  • An exhibition, showing, pop-up, market or special event;

  • A direct purchase from the Gallery; and

  • Any other sales channel operated by or on behalf of The Distelheim Gallery.

If a commission agreement, custom-order agreement, invoice, event agreement or other written contract contains terms that conflict with this policy, the more specific written agreement will control for that transaction.

Identity of the Seller and Protection of the Artist

Unless a separate written agreement signed by the relevant parties expressly states otherwise, all sales are made by The Distelheim Gallery, LLC.

The identification of Jefferey Cornett as the artist, artist-in-residence, designer, creative director, founder, representative or participant in connection with an artwork, product, event or communication does not make him the seller in his individual capacity. He does not personally guarantee, warrant or assume individual responsibility for the Gallery’s commercial obligations merely because his name, signature, likeness, biography, artwork or intellectual property appears in connection with a purchase.

Nothing in this section excludes responsibility that cannot lawfully be excluded or applies where Jefferey Cornett has expressly accepted an obligation in a separate written agreement signed by him individually.

Original Artwork and Collectible Art

All sales of original artwork are final.

Before purchasing, customers are encouraged to request additional photographs, dimensions, condition information or a private viewing when available. Natural surface variations, visible brushwork, texture, collage elements, irregular edges, variations in finish and other evidence of the artist’s process are characteristics of original artwork and are not defects.

Framing, glazing, matting and presentation materials may contain minor variations consistent with handmade or custom work. Unless specifically stated in writing, frames and display materials are considered part of the presentation and are not separately warranted.

Limited Editions, Hand-Touched Works and Reproductions

All sales of limited editions, numbered editions, signed editions, hand-touched works, artist proofs, prints and reproductions are final.

Minor differences may exist between individual pieces because of printing, finishing, trimming, hand embellishment, signature placement, numbering, paper characteristics or production techniques. Such differences contribute to the individual character of the work and are not defects.

Edition numbers may be assigned according to production and inventory availability. A customer is not entitled to a specific edition number unless that number is expressly confirmed in writing before purchase.

Certificates of authenticity, edition documentation and associated materials should be retained by the purchaser. Lost or damaged certificates may not be replaceable.

Custom Orders, Commissions and Personalized Products

All commissions, custom orders, personalized products, made-to-order merchandise, special sizes, custom framing, corporate orders and preorders are final and nonrefundable.

Deposits and advance payments are nonrefundable once the Gallery has begun creative work, planning, sourcing, production, printing, fabrication or other performance related to the order.

When a customer approves a design, proof, mockup, specification, color direction, size or production sample, that approval authorizes the Gallery to proceed. The customer is responsible for reviewing names, wording, measurements, addresses and other details before giving approval.

Requested changes after approval may be declined or may require additional charges and an adjusted completion date.

Scarves, Apparel and Other Wearable Art

All sales of scarves, T-shirts, apparel and other wearable art are final. For reasons that include product integrity, hygiene, limited-edition inventory and specialty packaging, these products cannot be returned or exchanged, even if unworn or unused.

Customers are responsible for selecting the correct size and reviewing garment measurements, fabric descriptions and care instructions before purchasing.

Small variations in color, placement, cropping, scale, stitching, fabric texture and print registration may occur during textile production. These reasonable production variations are not considered defects.

Damage caused by wearing, washing, dry cleaning, ironing, steaming, storage, perfume, cosmetics, jewelry, improper handling or failure to follow care instructions is not eligible for replacement, credit or refund.

Note Cards, Books, Albums and Packaged Products

All sales of note cards, stationery, books, albums, boxed products, gift packaging and similar merchandise are final.

Minor differences in paper, envelope color, printing, trimming, folding, packaging or presentation that do not materially interfere with the intended use of the product are not defects.

Digital Products and Downloadable Content

Purchases of digital artwork, music, recordings, downloads, electronic publications or other digitally delivered content are final once access, delivery or download instructions have been provided.

Digital products may not be returned. The inability to use a digital product because of a customer’s equipment, software, storage, internet connection or technical configuration does not create a right to a refund.

If a customer experiences a verified access or file-delivery problem, the Gallery may provide reasonable technical assistance or replacement access.

Event Tickets, Appointments, Salons and Programs

Unless expressly stated otherwise, fees for tickets, reservations, consultations, appointments, salons, classes, workshops and Gallery programs are nonrefundable.

Failure to attend does not qualify for a refund or credit. Requests to reschedule an eligible appointment must be received at least 48 hours in advance and remain subject to availability and Gallery approval.

If the Gallery cancels an event or paid program and does not provide a replacement date or comparable alternative, the Gallery will provide the remedy required by applicable law, which may include a refund of the amount paid directly to the Gallery. Third-party processing, travel, lodging, parking and other incidental expenses are not reimbursable by the Gallery.

Gift Cards and Promotional Credits

Gift cards, gift certificates and promotional credits are not redeemable for cash and are nonrefundable, except where cash redemption or another remedy is required by applicable law.

Promotional items, complimentary products and products received through giveaways have no refundable cash value.

Order Cancellations

Orders begin processing promptly. Once an order has been submitted, it cannot ordinarily be canceled or changed.

The Gallery may, in its sole discretion, approve a written cancellation request received before fulfillment or production begins. Any such accommodation is voluntary, may be conditioned upon recovery of payment-processing fees, production expenses, artist time, special-order costs or other amounts already incurred, and does not create an obligation to approve future cancellation requests.

The Gallery reserves the right to cancel an order because of suspected fraud, payment failure, pricing or listing error, inventory unavailability, production impossibility, legal restrictions or other legitimate business reasons. If the Gallery cancels an order before providing the purchased product or service, the Gallery will issue any refund required by applicable law.

Shipping Delays and Unavailable Merchandise

Production and delivery dates are estimates unless the Gallery expressly guarantees a date in writing.

If merchandise ordered online, by telephone or by mail cannot be shipped within the promised period—or within the period otherwise required by law—the Gallery will provide any delay notice, cancellation opportunity or refund required by applicable law.

Nothing in this policy permits the Gallery to retain payment for merchandise that it does not provide when the law requires a refund.

Damaged, Defective or Incorrect Merchandise

The Gallery’s no-refund policy does not prevent a customer from reporting merchandise that:

  • Arrived materially damaged in transit;

  • Contains a material manufacturing defect;

  • Is materially different from the item ordered; or

  • Was sent because of a verified Gallery fulfillment error.

The customer must notify the Gallery promptly and, whenever reasonably possible, within 48 hours after delivery. The notice must include:

  • The purchaser’s name and order number;

  • A written description of the problem;

  • Clear photographs of the item;

  • Photographs of the shipping container, label and all packaging;

  • Photographs showing the complete item and the specific damage or error; and

  • Any other information reasonably requested to evaluate the claim.

The customer must retain the item and all original packaging while the claim is reviewed. The item must not be used, worn, washed, altered, repaired, framed, reframed or otherwise modified.

Failure to preserve the product and packaging may prevent the Gallery or shipping carrier from verifying the claim and may affect the remedy available.

Resolution of Approved Claims

No merchandise may be returned without advance written authorization from the Gallery.

After reviewing an eligible claim, the Gallery may provide an appropriate remedy consistent with the circumstances and applicable law. Depending upon the nature of the claim, that remedy may include:

  • Repairing the item;

  • Replacing it with the same item, if available;

  • Replacing it with a reasonably comparable item with the customer’s agreement;

  • Reproducing or correcting the item;

  • Providing a Gallery credit; or

  • Issuing a refund when required by law or when the Gallery determines that no other appropriate remedy is reasonably available.

The Gallery does not guarantee that a sold-out, unique, original, hand-touched or limited-edition item can be replaced.

Approval of one claim or voluntary accommodation does not modify this policy or create a continuing obligation to approve another claim.

Color, Scale and Display Variations

Customers acknowledge that electronic displays, browsers, lighting conditions and photography can affect the appearance of colors, textures, contrast and scale.

The Gallery makes reasonable efforts to present its work accurately, but it cannot guarantee that a customer’s screen will reproduce physical colors exactly. Reasonable differences between an online image and the physical product are not defects and do not qualify for a return, exchange or refund.

Lifestyle photographs, room settings, mannequins, models, frames, easels and other display elements may be illustrative and may not be included unless specifically identified in the product description.

Delivery, Address and Refused Packages

Customers are responsible for supplying a complete and accurate shipping address and for ensuring that someone is available to receive or sign for a shipment when required.

A package refused by the customer, left unclaimed, or returned because of an incomplete or incorrect address is not treated as a valid cancellation or authorized return.

The customer may be responsible for additional shipping, insurance, handling, storage and redelivery costs. Original shipping, expedited shipping, delivery, insurance and handling charges are nonrefundable except where otherwise required by law.

If tracking shows delivery but the customer cannot locate the package, the customer must promptly contact the carrier and the Gallery so that an investigation may be requested. The Gallery does not guarantee the outcome of a carrier investigation.

Unauthorized Returns

Products returned without advance written authorization may be refused and do not qualify for a refund, exchange or credit.

The customer remains responsible for all expenses associated with an unauthorized return, including return shipping, insurance, storage and redelivery.

Providing a return address or receiving a package does not constitute approval of a return or acceptance of a refund obligation.

Price Adjustments and Promotions

The Gallery does not provide retroactive discounts, refunds or price adjustments because an item is later discounted, included in a promotion, offered with different packaging or made available in another edition, size or product format.

Promotional codes must be entered or presented at the time of purchase and cannot be applied after an order is completed.

Payment Disputes and Chargebacks

Customers are encouraged to contact the Gallery promptly if they believe a billing or fulfillment error has occurred so the matter can be reviewed.

Nothing in this policy limits a customer’s lawful rights regarding unauthorized charges or legitimate billing errors. However, the Gallery reserves the right to contest improper, inaccurate, fraudulent or abusive payment disputes and to provide the payment processor with the order record, this policy, proof of customer acceptance, communications, shipment tracking and delivery documentation.

Mandatory Legal Rights

This policy is intended to apply to the fullest extent permitted by law. It does not waive, restrict or eliminate any consumer right or remedy that cannot legally be waived.

Where the law governing a transaction requires a refund, cancellation right, replacement or other remedy, that legal requirement will control only to the extent of the conflict.

The federal Cooling-Off Rule generally does not apply to transactions completed entirely online, by mail or by telephone, or to qualifying arts and crafts sold at fairs and similar locations. When a transaction is legally subject to a mandatory cancellation period or other non-waivable requirement, the Gallery will honor that requirement.

Acceptance of This Policy

By placing an order, submitting payment, signing an invoice or purchase agreement, accepting delivery, or completing an eligible Gallery transaction, the purchaser acknowledges that they had an opportunity to review this policy and agrees that:

ALL SALES ARE FINAL. NO REFUNDS, RETURNS, EXCHANGES OR CANCELLATIONS WILL BE PROVIDED EXCEPT AS EXPRESSLY STATED IN THIS POLICY OR REQUIRED BY APPLICABLE LAW.
